With a courageous judgment, the Constitutional Court extends the application scope of art. 25, par. 2, Cost. in the criminal enforcement sector. Censoring the living law, the Court states the prohibition of the retroactivity of the measures more afflictive introduced by law no. 3 of 2019 to convicts who committed the fact before its entry into force. The Author, after dwelling on the new paradigm of "European legality", retraces the salient passages of the decision, from which it draws the innovative message of the Judge of the laws.

The essay is about limits imposed to the legislature to enact retroactive statute law in “civil matters”. It tackles the dichotomy existing between the European Court of Human Rights’ and the Italian Constitutional Court’s jurisprudence on the theme. Le coppie di fatto e quelle omosessuali in particolare sono da tempo una componente della società italiana. La Corte europea dei diritti dell'uomo nella sentenza Schalk and Kopf del 2010 ha riconosciuto la relazione omosessuale come una delle possibili manifestazioni della vita privata e familiare, la cui tutela è sancita dall'art. 8 Cedu. Anche la Corte costituzionale italiana ha attribuito alla relazione omosessuale la connotazione di "formazione sociale", i cui diritti inviolabili sono riconosciuti e garantiti in base all'art. 2 della Costituzione.
